Did Victim Have Consensual Sex with Gavin Gao? Angry Husband Called Cops

In the trial hearing for Gavin Gao‘s (高雲翔) assault case in Sydney today, defense lawyers are trying to prove that the sex was consensual after all. The alleged victim, a 36-year-old Chinese-Australian woman who worked on the Love in Aranya <阿那亞戀情>  filming set, was said to have been highly interested in the Mainland Chinese actor. After they had intercourse inside a hotel room, the woman tried to hide it from her husband. Outraged by what happened, it was the husband who had called the police, resulting in Gavin’s arrest.

In March, Gavin, along with Wang Jing (王晶) were charged for sexually assaulting the woman inside a Shangri-La Hotel room in Sydney. Wang had led the woman to the hotel room, where Gavin was waiting inside. Gavin’s DNA was found in blood and semen stains on the hotel pillowcase.

Gavin’s defense lawyer, John Korn, provided CCTV footage to prove that the woman carried a flirtatious air with Wang Jing. Witnesses saw that the pair behaved intimately over dinner. Wang Jing and the woman also shared a passionate five-minute kiss at a karaoke bar hours before the alleged sexual attack. The woman did not resist the kiss.

The defense also pointed out that the woman had several chances to go home, but chose to remain in Wang Jing’s company. After the karaoke gathering concluded, video footage clearly showed that the woman told the filming crew’s car to not wait for her, while also canceling the car service she had called.

The woman’s testimony revealed that she agreed to go to Wang Jing’s hotel room because she knew Gavin was there and wanted to interact with him.

It was apparent that Gavin’s defense lawyer had gathered strong evidence in applying for bail this time, after the initial application was rejected. However, the trial proceedings were handled very cautiously due to the high-profile nature of the case. Justice Lucy McCullum will announce the decision on bail application tomorrow at 2 p.m.

      I wouldn’t say he was unlucky. If he there was no doubt it was just infidelity he would have walked free by now. I think he would shake your hands off if you offered him a ruined career and marriage now….

      @jimmyszeto Any woman that scream rape true or not as long as she accuse him of it they are treating him as a criminal until they are proven innocent even than people will still assume he is still guilty. People has no tolerance for sexual assault

  3. Women’s rights are stronger in western countries. If this happened in China or even Asia, all fingers will point to the woman. Consent of sex and being friendly with the accused are two different issues. The most damning evidence are the bruises on the woman’s thighs and feet as reported earlier (if the report is true). Yes, I agree that the police surely will not detain them if there are no strong evidence of assault so I assume the bruises are true unless they blamed self infliction.

    As a woman, I find the constant use of ‘consensus’ in these type of cases an insult to my privacy and right as a woman. Women are blamed to invite rape because of their dressing, the jobs etc etc. Just because one is prostitute does it mean she has no right to reject a client? Just because one likes to wear sexy clothes does it mean she has no right to say no to men? I remember watching this movie, LIPSTICK many years ago where a model was raped and stalked by her younger sister’s psycho teacher. She lost the case because the defendant claimed she was friendly to the psycho and she was a bikini model. The ending … the psycho teacher raped her younger sister to take it out on her. She snapped and shot the psycho.

    1. @mangotango You can’t use that for every case, though. As a girl myself, I sometimes really hate how women always use the “I have the right to say no if I don’t wan to have sex”, even when you already play it through more than half way. Like seriously, if you don’t want to have sex or anything, why not be cleared with the other party especially men. Many men would think you’re playing hard to get increasing the mood. Then many women will be like: it will be hard to say no in a situation like that. Either way, it’s always the men’s fault. That’s always how it is in society, especially in the west where a man will get arrested automatically with no questions. Very rare case where police will questions both parties.

      Also, their are cctv where the woman in this case kissed, hug and did intimacy stuffs with that Jing guy. After did all those stuff, she went to the hotel room with him. You can’t tell me she’s innocent. Just because she’s a woman, she has her right, doesn’t make her 100% innocent when she already played through the game. I find it funny how a woman can play through until the guy is going to insert his D into her and she said no. She is 100% innocent and right. Like really? The guy probably didn’t know or think your “NO” is really a no. He probably think you’re playing becuz you already got it through that far. Also, when the woman pull the guys’ pant off and suck/fuck him when he didn’t want to, women will say, ” well, men are horny creatures so. Even a wife can accuse her husband for raping her when she decided that she wanted to stop or didn’t want to have sex. Case like this, I usually listen with 1 ear and keep 1 ear becuz there are always 2 sides to a story. Maybe both sides are right/wrong.

      I’m in favor of women power, ofc, but not when we are wrong and we think we have our rights to say whatever we want (not in this case becuz we don’t know the real story). Also, just becuz the person involved in such case is a woman, we automatically assume she’s innocent and support her. I don’t think that’s right. I as a girl know in the future I will have children. I don’t want that to happen to my son where he is going to be wrong/judged already in the beginning. It is a lose-lose situation for almost every man.       a bit of an assumption that “strong evidence of assault” was why the police decided to press charges.

      plenty of cases have gone to trial with very weak evidence, and the accused found to be innocent later.

      even if evidence was extremely weak, it would be likely the police would move to prosecute to prevent him from leaving the country.

  5. Latest report that Gsvin is granted bail with deposit of 3M$ (Aussie dollars?). Conditions appear to include wearing electronic trackers, wifey and daughter’s passport taken by police, report to police station twice a day, I think they are allowed to live or go near airport too.

  7. One, just because a woman is friendly and flirtatious, it doesn’t mean she wants se x. If she leads you on and then says no thanks, she’s a “female dog” but that doesn’t mean you can force her into the act.

    Two, a woman should not call rape afterward because she regrets in the morning either. For those who do that, they’re double “female dog” because one, you reap what you sow; and two, you do other women, real rape victims a disservice.

    Three, we’re in this era of guilty until proven innocence is scary af. Social justice warriors ruin life, career and reputation before a trail is even given. Good thing they don’t have power to actually punish someone in the name of laws. Phew.

    With that said, I still support the #metoo movement. Even if there are double-b in point two above and side effects of point three above, it’s still a platform and venue for actual victims to speak out, get support and closures. Idk the statistic between real victims vs liars, even if it’s just one real, I still think it’s worth it. Because remember, the movement has no legality against/support. It’s still must be presented, judged and sentenced in a court of law.

    Back to the article, refer to my point one above. Hypothetically, what if she wanted intercourse with GG and then WJ butted in for a 3some which made her have second thought but they forced her into anyways? It’s still rape. That’s pretty lame (her husband is jaded and wants to sue) and weak (she asked foe it) defense IMO.

    BTW, I used woman vs man as victim vs accused, respectively but it doesn’t mean I don’t believe the roles cannot be reversed.

    1. @jjwong I agree with most of what you said. Many women are using the #metoo movement to their advantage, exploit it. A bad date/sex is not sexual assault. And I just want to say alittle about the part where a woman can play it through until they are going to have sex and she changed her mind. The guy may not really think her no means NO. You know like when he’s going to penetrate her and she decided not to have sex. The guy probably think she’s playing to get the mood on. As women, we should be really clear and careful of what we want and don’t want and our own safety. The case in this article is probably like what you said that the woman wanted to have sex with that guy Gavin. But there are CCTV that showed she was kissing and hugging that WongJi guy too. I guess they did plan to have a 3some but something went wrong.

      1. @sabrina The whole “no doesn’t really mean no” is a slippery slope. 1) I believe for the sake of humanity, women need to stop doing it and men need to stop assuming it. “It” as in no means maybe or even yes BS. Then, maybe then, we can be real where a no is a no. 2) If “it” is used for foreplay, then it needs to be confirm. A simple affirmation “do you really mean no” or “I don’t want se x” would suffice. Like you said, we (both women and men) need to be clear and careful because there are negative consequences on and for both sides.

        You could be right; she might be on the 3some all along but she chickened out the last minute. I honestly don’t have a judgement for either side. I simply don’t know or follow the case enough. I just wanted to comment that:

        PS Why is there no news on WJ guy btw? What’s his lawyer is saying? Didn’t GG originally claim he was only a bystander and watched? Also, couldn’t they look at police report to see who reported the crime since the article claimed the husband called it in?

      2. @jjwong That is also what I wanted to know about that other guy. And I think if police dig deeper into the case, there might be even some dirtier evidence. As we all know, the entertainment industry is not clean. So, this might not be the first time they did it.

  8. The whole ‘drama’ is bizarre. The first impression was Gavin was the bystander and now WJ is bystander. With snippets of information, theories and assumptions abound. LOL.

  9. Just read on another site, on the paper, it’s said that the reason why GG was in the room was because WJ called GG to his room. After that, he then kissed the victim, then proceed to the bed. However, the victim claimed each of them held her legs, throw her into the bed while she struggled to free herself from them, hence the injury on her leg.
